Terms of Service

1. Account Responsibilities
You are responsible for maintaining the security of your account credentials and all activity under your account. You must provide accurate registration and billing information and keep it up to date.
2. Acceptable Use
You agree not to use Ecomera for unlawful activity, abuse platform integrations, attempt unauthorized access, or interfere with service integrity, security, or availability.
3. Subscription and Billing Terms
Paid plans renew according to your chosen billing cycle unless canceled before renewal. You authorize Ecomera to charge subscription fees, usage-based fees, and applicable taxes to your selected payment method.
4. Cancellation Policy
You may cancel your subscription at any time. Cancellation prevents future renewals but does not retroactively refund previously billed charges unless required by law.
5. Refund Policy
Except where legally required, all fees are non-refundable. If a refund exception is granted, it is at Ecomera's sole discretion and applies only to the specific charge approved.
6. Limitation of Liability
To the maximum extent permitted by law, Ecomera is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, goodwill, or data.
7. Service Level Agreement (Scale Tier)
Customers on the Scale tier may be eligible for uptime and support response commitments defined in a separate SLA document. If there is a conflict, the signed SLA terms govern for Scale-tier commitments.
8. Intellectual Property
Ecomera retains all rights, title, and interest in the platform, software, and related content. You retain ownership of your data and grant Ecomera limited rights to process it solely to provide the service.
9. Termination
We may suspend or terminate access for material violations of these terms, non-payment, legal requirements, or security risk. Certain provisions survive termination, including payment obligations and liability limits.
10. Governing Law
These terms are governed by and interpreted under applicable local laws in the jurisdiction stated in your order form or master agreement. Disputes are resolved in the competent courts of that jurisdiction.
